The short version
- We build your website for free and you rent it by the month.
- There’s no contract. Either of us can end it with one month’s notice.
- If you leave, the site comes down and the design stays with us.
- Your domain, logo, photos and wording always stay yours.
- The full terms below are what apply if there’s ever a disagreement.
About these terms
These terms are the agreement between you (the business signing up) and Page Design Wales, run by Phil Page, a sole trader trading as Page Design Wales.
What you get
We design, build, host and look after a website for your business, with the number of pages in your plan. We charge nothing to build it. In return you rent it from us for a monthly fee. Each plan includes:
- UK hosting and an SSL certificate
- Daily backups and uptime monitoring
- A site that works on phones, tablets and computers
- One small edit a month (see section 8)
Prices and payment
- The monthly price is £10 plus £5 for each page. A three-page site is £25 a month.
- An online shop adds £15 a month for up to 50 products, or £25 a month for unlimited products, plus 1% of shop sales (see section 9).
- Prices don’t include VAT. If we charge VAT, we’ll show it on your invoice.
- You pay monthly in advance by the method agreed when you sign up. Your first payment is due when your site goes live.
- If a payment fails, we’ll tell you. If it’s still unpaid after 14 days, we may take your site offline until you’ve paid.
- If you add or remove pages, your price changes from your next payment.
- We’ll give you 60 days’ notice of any price rise. You can cancel before it starts (see section 4).
Changing or cancelling
There is no minimum term and no cancellation fee. Either of us can end the agreement at any time by giving one month’s notice. You can cancel by emailing us at philwebguy@gmail.com. You pay up to the end of the notice period.
We can end the agreement straight away if you seriously break these terms, for example by not paying after we’ve warned you, or by putting unlawful content on your site.
The website is rented
This is why the build is free: you’re renting the website, not buying it. It stays live while you’re paying for it. When the agreement ends, we take the site down. The design, layouts, code, templates and any software we used remain ours, and we don’t hand over the site files.
We’ll delete the site and its backups within a reasonable time after it ends. If you’d like to keep a copy of your site, ask us before you cancel. We may offer a one-off price for that, but we’re not obliged to.
Your domain
- Your domain name is bought and registered in your own account, so you own it.
- You give us access, or add the settings we ask for, so we can connect it to your site.
- You can take that access away at any time. If you do, your site will stop working until the domain is connected again.
- You pay the registrar’s renewal fees and keep your contact details up to date.
- We never lock you in or hold your domain. When the agreement ends, you keep it and we remove our access.
Your content
You keep ownership of everything you give us, such as your logo, photos, text and prices. You promise that you have the right to use it. You give us permission to use it to build, host and show your website. When the agreement ends, we stop using it and you still own it.
Edits
Each month you can ask for one small edit. A small edit is a quick change such as updating text, swapping an image or changing opening hours. It doesn’t roll over if you don’t use it.
Extra small edits cost £15 each. Bigger changes cost £40 an hour. We’ll tell you the price before we start and won’t charge you without agreeing it first. New pages are priced as pages in your plan.
Online shops
- We use Stripe to take payments. You’ll connect your own Stripe account and agree to Stripe’s terms.
- Customers’ payments go to your Stripe account. We never hold your money.
- We take 1% of each sale as a fee through Stripe. Stripe also charges its own card fees, and those are separate from ours.
- You’re the seller. You’re responsible for your products, prices, delivery, refunds, tax and following consumer law.
Keeping the site running
We’ll take reasonable care to keep your site online, backed up and secure. Sometimes we need to do maintenance, and sometimes things outside our control cause problems, so we can’t promise it will never go down. If something goes wrong, we’ll fix it as quickly as we can, including restoring from a backup.
Your responsibilities
- Give us accurate information and tell us when it changes.
- Make sure what appears on your site is lawful, honest and doesn’t infringe anyone else’s rights.
- Keep any login details safe.
We can remove content that breaks the law or these terms.
Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
Otherwise, we’re not responsible for lost profits, lost business or indirect losses. Our total liability to you for anything connected to the service is limited to the fees you paid us in the 12 months before the problem happened.
Your data
We use your details to set up your site, take payment and reply to you. We don’t sell them. If your website collects personal information from your customers, such as through a contact form, you’re responsible for explaining that to them, and we’ll process it only to run your site.
Changes and law
We may update these terms. If a change is to your disadvantage, we’ll give you 60 days’ notice, and you can cancel before it takes effect. The date at the top shows when they were last updated.
These terms are governed by the law of England and Wales, and the courts of England and Wales can decide any dispute. If you have a problem, please contact us first at philwebguy@gmail.com and we’ll try to sort it out.
